View Full Version : Exoto Continental Mark II convertible.

Those of you familiar with the higher-end model world know the name Exoto. I was contacted by their owner, Tony K, about them using my car to model after. I clarified that mine was not the WCF Mark II convertible but he liked mine better. He was enamored with the metal boot.

All I asked in return was the prototype and one production model. He agreed. He's shown the model all over the world. It's clearly my car as there is no other like it. I've called to ask to buy the prototype, but my calls go unanswered.

Do I have any claim to that model?

That sure is your car Barry but you did give the guy permission to copy . Do you have anything in writing? If so then your claim is limited to what the agreement says. If not then you probably have no claim.

Actually I have a model of this car somewhere unmade and in the original box. Just for kicks what's to prevent me from making this model in the likeness of your car? Maybe I'm missing something here. Did this guy want to make the model of your car to sell? Maybe there would be a copyright thing here on that but if he just made the model for himself I don't think that could be stopped.
I'd like to know what happens with this so hope you will post the outcome. Pete

Glad you landed here.

Exoto is a huge company. They wanted to make a model of my car for sale and profit.

I have no objection to anyone using images of my car or wanting to build a model of it. In fact, I'm flattered by it, as you could imagine.

so they gave you a production model but not the production prototype?

No, maybe I wasn't clear. These are pictures of the prototype, which has been shown all over the world to garner interest in the model. They have shown a stock Mark II in their "Coming soon" section of their web site for 4 years, but have not put either model in production.

I was told by Tony K that the prototypes are worthless to him as they just take up physical space when they really only need the tooling information that's already been digitized.

Yes, I gave him permission to copy my car, under the assumption that I would get something in return. It's been 5 years.

Since he's expressed that he doesn't need the prototype, I think it should be in my possession, as promised.

Have a lawyer send Tony a registered letter asking him what his intentions are for the model. Maybe shaking the tree a little will bear some fruit. Pete
